A Conditional Use Permit (CUP) is a land use permit that is granted for a specific location, subject to requirements (conditions) applied to ensure compatibility of the use with other land uses in the area.

The Development Code specifies which uses are permitted and which uses are permitted subject to a CUP for each land use district.
Who approves a CUP?
The Planning Commission is the approval authority for CUP’s. The application is filed with the Planning Division, staff prepares a report of recommendation and presents the application to the Planning Commission at a public hearing. The decision of the Planning Commission may be appealed to the Mayor and the Common Council.
What kinds of conditions are applied to a CUP?
Hours of operation, restrictions on noisy outdoor activities or unsightly outdoor activities or unsightly outdoor storage, landscaping requirements for screening, extra security measures and maintenance requirements are typical conditions.
Who checks on compliance conditions with the conditions of approval?
